About the Role
The position of Prosecutor reports to the Senior Prosecutor and is responsible for prosecuting matters on behalf of DTP in the various Magistrates’ and Children’s Court of Victoria venues
Position Outcomes / Accountabilities
- Provide prosecution services to the highest standard, including (inter alia):
- Examining and assessing evidence collected by authorised officers and making appropriate decisions to prosecute in accordance with relevant policy and procedures in accordance with governing legislation and best practice (such as model litigant guidelines);
- Attend various Magistrates’ and Children’s Court venues throughout metropolitan and regional Victoria to appear on behalf of DTP;
- Discharge all prosecution functions in an efficient, professional manner, including instructing counsel where required; and
- Liaise with accused person(s) and/or their legal representatives to achieve successful outcomes at court in accordance with the law and departmental policy.
- Prosecute contested matters, including (inter alia):
- Arranging and proofing witnesses;
- Ensuring DTP’s responsibilities are discharged subsequent to any court decisions/orders;
- Advising on the prospects of appeal, when applicable.
- Provide informative and authoritative legal advice; legal and prosecutorial training and assistance for public transport operators, including their authorised officers regarding all legal and/or enforcement practices and procedures.
- Develop and maintain constructive relationships across the branch, the department, public transport companies, Public Transport Victoria, the Department of Justice and Community Safety, and the courts.
- Within limited time constraints, monitor and report on prosecution activities and provide relevant information on outcomes, including court outcomes, to management.
- As required, contribute to other branch initiatives, deliverables, project teams, working groups and other tasks that contribute to the objectives of TRO from time to time.

Your experience in dispute resolution will enable you to identify opportunities for early resolution, conduct negotiations, and effectively manage external legal services to ensure excellence.
A strategic mindset is essential; you will think system-wide, anticipate future trends, and translate strategic priorities into actionable plans for yourself and others. Critical thinking and problem-solving capabilities are key, with an ability to evaluate complex issues from multiple perspectives and embed sustainable solutions that drive real business outcomes.

Qualifications and Experience
Mandatory
-
- Admitted to practice as an Australian Lawyer; or
- Demonstrable experience prosecuting as a non-Lawyer under an ‘Instrument of Authority’ (i.e. a role akin to a ‘Police Prosecutor’)
Desirable

- Demonstrable experience working within the criminal jurisdiction.
